My 12yr old daughter was caught kissing and touching my neighbors 8yr old son what can happen to her legally? ?

I already talked to her and asked if she had been molested she promised no. I have talked with my x husband and we r going to put her in counseling. I don't want my daughter to be a child molester or registered sex offender what kind of legal action should I seek if the boys mother presses charges ir whatever happens. I never been in this situation before. Please help is my daughter a child molester this has never happend she swears she never done this before. I spankes her and had a talk with her. I told her that she has ruined her life and what are we to do if they send her away. I don't know what to do? Please help with advice don't talk down or bad mouth.
